Terms of Service

These Terms of Service ("Terms") govern your use of the Bust Down AI mobile application ("App") operated by Intellekt LLC ("we", "us", "our"). By using the App, you agree to these Terms.

1. Account Requirements

To use Bust Down AI, you must:

• Be at least 13 years of age
• Sign in with a valid Apple ID using Sign in with Apple
• Provide accurate information and maintain the security of your account

Anonymous sign-in is not supported. You are responsible for all activity under your account.

2. Credits and Subscriptions

Free Credits

New accounts receive 3 free credits. Free-tier generations are limited to 1K resolution and include a watermark on the generated image.

Credit Purchases

Additional credits can be purchased through in-app purchases via Apple's App Store. Credit packs are one-time, non-recurring purchases. Credits do not expire as long as your account remains active.

Subscriptions

Weekly subscription plans provide recurring credits and additional benefits including discounted generation costs and the ability to unlock watermarks on past free-tier generations. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.

Refunds

All purchases are processed by Apple. Refund requests must be made through Apple's standard refund process. We do not process refunds directly.

3. Acceptable Use

You agree not to use Bust Down AI to:

• Generate content depicting minors in any inappropriate context
• Create content that is illegal, harmful, threatening, harassing, or discriminatory
• Impersonate other people with intent to deceive or defraud
• Generate content that infringes on third-party intellectual property rights
• Attempt to reverse-engineer, exploit, or abuse the service
• Circumvent rate limits, credit systems, or other restrictions
• Upload malicious content or attempt to compromise the service

We reserve the right to suspend or terminate accounts that violate these guidelines, without refund.

4. AI-Generated Content

Ownership

You retain ownership of the photos you upload. Generated images are created by AI based on your inputs and our prompt system. You may use generated images for personal, non-commercial purposes. Commercial use of generated images is permitted, subject to the limitations below.

Brand and Intellectual Property Disclaimer

Generated images may depict items styled after recognizable luxury brands, designer labels, and streetwear. These depictions are AI-generated artistic interpretations and do not represent endorsement by, affiliation with, or licensing from any brand. You are solely responsible for how you use generated images and any intellectual property implications.

No Guarantees

AI generation is inherently variable. We do not guarantee specific results, quality levels, or that generated images will match your expectations. Each generation costs credits regardless of the outcome.

5. Watermarking

Free-tier generations include a "BUST DOWN" watermark on the generated image. This watermark is part of the service tier differentiation. Attempting to remove watermarks through external tools is permitted, but we make no warranties about image quality after watermark removal. Active subscribers can unlock watermarks on past free-tier generations through the App.

6. Content Storage

Your uploaded photos and generated images are stored on our servers. We reserve the right to remove content that violates these Terms. You can request deletion of your data as described in our Privacy Policy.

7. Service Availability

We strive to keep Bust Down AI available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law:

• Bust Down AI is provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim
• We are not responsible for the content of AI-generated images or how you choose to use them

9. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may stop using the App at any time. Upon termination:

• Your access to the App will be revoked
• Unused credits are forfeited and non-refundable
• Active subscriptions should be cancelled through Apple's subscription management
• Your data will be handled according to our Privacy Policy

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
